Alteração da lei de recuperação de empresas e falência: uma avaliação a partir de dados empíricos depois de mais de uma década de vigência

Após mais de uma década desde a entrada em vigência da Lei 11.101/05, pretende-se com este trabalho tentar identificar, principalmente por dados estatísticos e empíricos, se os seus objetivos estão sendo alcançados, tal como idealizado. A metodologia a ser utilizada é a da finalidade de pesquisa aplicada, com objetivo exploratório, em abordagem quali-quantitativa, por método dedutivo, mediante pesquisa bibliográfica, jurisprudencial e levantamento de dados. Inicialmente será feita uma contextualização do tema, mediante abordagem dos princípios da função social e preservação da empresa. Após, serão apresentados dados empíricos referentes às recuperações judiciais existentes no Brasil nos últimos anos.
