Deepfakes, Democracy, and gender-based political violence
social harms in the São Paulo elections under the Big Tech regime

This article analyzes political gender-based violence perpetrated through deepfakes in elections, with a legal-criminological perspective exemplified by the 2024 São Paulo municipal election. The central problem investigates the social harms generated by these criminal behaviors. The objective is to identify and analyze such harms, focusing on the use of AI for gender-based attacks. Methodologically, a deductive approach and a monographic procedure are adopted, with indirect bibliographic and documentary research. The conclusion is that the harms are multifaceted, operating on both the individual (violation of honor, image, and privacy) and collective (erosion of democratic trust and reinforcement of patriarchal stereotypes) dimensions. Deepfakes are shown to be instruments of oppression, amplified by the logic of digital platforms. Regulatory inadequacies and institutional delays exacerbate victimization, demanding an integrated response that addresses both technological tools and the sexist structures that sustain them.
