The present article aims to reflect on the use and development of artificial intelligence as a mechanism of political influence, exploring the risks to the maintenance of democratic regimes with an emphasis on the creation and dissemination of fake news. Thus, it develops a reflection on how the lack of clear regulation regarding the use of AI can compromise constitutionally guaranteed rights, requiring a robust regulatory framework to mitigate these risks. To this end, it employs bibliographic research with a qualitative approach, combined with an analysis of Brazilian legislation. As a result, it provides an academic critique of the national judiciary's structure, in light of the ineffective legislative development on the subject, and an analysis of the current paradigm.
