This article aims to analyze the changes to the Maria da Penha Law, introduced by Law 14,550/2023, and the protocol for judgment with a gender perspective, launched by the National Council of Justice in 2021, with the aim of collaborating with the combating violence against women by the Judiciary, and identifying whether, using such instruments, the State fulfills its state duty to protect women. The trials that take place in the different areas of Justice must contribute to combating violence against women and fulfill the right to equality and non-discrimination, so that the exercise of the judicial function occurs in a way that fulfills a role of not repeating stereotypes , of non-perpetuation of differences, constituting a space for breaking cultures of discrimination and prejudice.
