This article aims to examine the use of artificial intelligence in the Criminal Process, as well as its use as mechanisms to accelerate the process. Technology, as a mechanism at the service of human beings, makes it possible to consider how its implementation can influence human activities and fundamental rights guaranteed by the Constitution of the Federative Republic of Brazil of 1988. Artificial intelligence has been used by the judiciary and the use of technological tools are applied at various stages of the Criminal Process. Artificial intelligence has proven to be a strong tool for addressing the challenges encountered by the judicial system by offering mechanisms that speed up the processing of processes and improve the system's effectiveness. However, the use of artificial intelligence raises ethical questions in relation to fundamental rights and the need for regulation and human supervision to ensure compliance with legal standards, because, even if artificial intelligence violates certain fundamental rights and guarantees of citizens, it necessary for the preservation of the common good. For the development of this article, the hypothetical descriptive method was used, in analysis of the Brazilian legal system, through methodological procedures of bibliographical research on the topic.
