Abstract

Abstract: The Constitution guarantees the civil right to inheritance, the succession process of which begins with death. The lack of succession planning can result in an arduous, conflicting and financially burdensome task for the heirs. That said, some advantages of carrying out succession planning include, for example, the reduction of legal disputes, the prevention of emotional distress, the reduction of financial costs and the preservation of assets. In turn, succession planning facilitates the transfer of assets, avoids family conflicts and promotes well-being among the heirs. In addition, it allows the testator to have control over the distribution of his assets, ensuring the autonomy of the private will of his decisions, comfort and stability for his family and loved ones after his death. From this perspective, this study analyzes testamentary succession planning, considering the economic, social and procedural aspects. The methodology used was qualitative research based on a bibliographic review of doctrines, legislation and scientific articles. It is important to conclude that testamentary succession planning, when carried out under the guidance of a qualified professional, is a rational and necessary act that contributes to the social and economic development of the author of the inheritance, guaranteeing the preservation of the assets and promoting family peace for him and his heirs.
