CONTROL OF CONVENTIONALITY OF LAWS AND HUMAN RIGHTS: THE RIGHT TO PROTECT THE POPULATION FROM TOBACCO SMOKE

The objective of this research is to present particularities of conventionality control through a brief analysis of human rights, giving special attention to the smoking-free environment. In this line, it is possible to verify the indispensability of carrying out the control of conventionality, due to the analysis of the validity of a legal rule in the face of treaties and conventions on human rights. The methodology used in the research was the inductive method, based on research of doctrinal works and legislation. In addition to scientific research published in qualified journals.
