This article aimed to analyze the conditions for dependency work in Brazil, considering the accompanying assistance provided for in Law nº 8.213/91. The research had a hypothetical-deductive approach, exploratory nature and qualitative character. In the first chapter, based on Eva Kittay's theoretical framework, dependency relationships and caregivers' demands were addressed. The second pointed out the difficulties that neoliberalism has imposed on these relationships, by rekindling familism and reducing investments in social rights. In the third, it was attested that there is a lack of norms and policies for dependency work and that accompanying assistance is incapable of filling this omission. It was concluded that this gap violates the rights of elderly and disabled people and their caregivers to social assistance. It was proposed the creation of an assistance benefit to implement care for dependency workers.
