Fungibilidade entre tutela antecipada e tutela cautelar
Abstract
A inserção do princípio da fungibilidade entre as tutelas de urgência aconteceu com o acréscimo do § 7º ao art. 273 do CPC, pela Lei 10.444/2002. Após feitas as definições e delimitados os requisitos de ambas as tutelas procedeu-se ao estudo específico sobre a fungibilidade, destacando-se suas conseqüências para o processo civil, inclusive a questão do esvaziamento do processo cautelar.
