Abstract

The scientific article will analyze the possibility of civil liability for acts resulting from emotional abandonment and parental alienation, with inflection, for the presence of all elements that configure civil liability. This legal institute was dependent on the 1988 Constitution of the Federative Republic of Brazil, which established several basic foundations in the full protection of children and adolescents, including the principles of affection and solidarity, foundations of family relationships, and which started to consider children and adolescents as subjects of rights, deserving of special protection by the State, society, and, above all, the family, with absolute priority.
