Abstract

O presente artigo tem por objetivo analisar o tema da sistemática da Responsabilidade Civil nos casos de danos processuais em sede ações coletivas. Analisa a questão de quem seria o responsável por arcar com os prejuízos causados em razão da execução de uma medida judicial, em decorrência de liminar ou antecipação de tutela, mas que posteriormente foi revertida, extinta ou modificada. Também apresenta as novas tendências da Responsabilidade Civil e os fundamentos da Teoria Subjetiva e Objetiva nos casos de danos processuais.
