THE PROVISORY EXECUTION OF THE SENTENCE IN BRAZIL AND THE INTERNATIONAL ORDERS OF CRIMINALIZATION

This article intends to discuss the relationship between the provisional execution of a criminal sentence, adopted by the Federal Supreme Court in HC 126292 / SP, and the international protection of human rights, due to the international mandates of criminalization. Firstly, consideration will be given to international protection of human rights and mandates of criminalization. Next, the content and purpose of the criminalization warrants will be exposed. Finally, consideration will be given to the relationship between the warrants of execution and the provisional execution of the sentence in Brazil, demonstrating that the new understanding of the Supreme Court is the best suited to the protection of Human Rights.
