Due to legislative inertia in determining the maximum period for the duration of criminal proceedings and pre-trial arrests, it was necessary to transfer to the judiciary the task of evaluating and determining what would be reasonable in terms of the duration of the proceeding. Such reasonableness, in practice, is being determined by the theory of the three criteria developed by the International Human Rights Courts. Therefore, the present article intends to analyze (i) if the Brazilian higher courts are applying the theory of the three criteria, in the way developed by the Internacional Courts, to assess the time reasonableness of the proceedings, (ii) if the empirical data related to the proceedings duration and the pre-trial arrests in Brazil reveals regional discrepancies and excessive time limits and (iii) whether the current mechanisms available to the defendant are sufficient to guarantee the reasonable duration of the proceeding. In addition, it will be analyzed whether and how the periodic control of pre-trial arrests, implemented by Law No. 13.964/19 (Lei Anticrime), may function in order to achieve the reasonable duration of the proceedings.
