The present article aims to approach the controversial points about the Serra da Canastra National Park and its history, presenting the struggle in reconciling the ideal of environmental preservation implanted, with due respect to the cultural and social context of the region’s residents. These local inhabitants are the so-called "Canastreiros", a traditional population that is located in the Canastra region. The intention is to demonstrate that it is possible to balance the legal conflicts resulting from the shock between the culture of the traditional residents of that area and the preservation of the environment, respecting the Conservation Units’ agenda of protection. It is not necessary to remove individuals from the preservation area, even though permissiveness of staying does not necessarily imply in a negligence to the environment. Cooperation between the parties is aimed to ensure that there are no major environmental impacts without causing legal uncertainty to the inhabitants of the area. Therefore, the methodology used was the bibliographical research, featuring case study, based of analysis of documents, jurisprudence, doctrines and studies regarding the Canastra conflicts.
